These Terms of Service ("Terms") govern your access to and use of Themerella: Wallpaper & Widget and any related applications, products, features, content, and services offered by Themerella development team (collectively, the "Services"). By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You represent and warrant that you are at least 13 years old, or if under 13, that you have the consent of a parent or legal guardian. The Services are not intended for children under the age of 13.
We may modify these Terms from time to time. If we make material changes, we will provide notice via the app or other reasonable means. The updated Terms will take effect when posted. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.

Some features may require you to sign in. If you sign in with Apple, you authorize Apple to share the basic account information you approve (for example, name and email). By subscribing, you authorize charges through your Apple account. Subscriptions automatically renew unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel subscriptions via your Apple account settings. Any unused portion of a free trial is forfeited upon purchase of a subscription. Refunds are subject to Apple’s policies.
All intellectual property rights in the Services and their content (excluding content you submit) are owned by Themerella development team or our licensors. You may not copy, modify, distribute, sell, or create derivative works of the Services except as expressly permitted. You retain ownership of any content you create or upload ("Your Content"). By uploading or submitting Your Content, you grant Themerella a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, create derivative works, communicate, publish and display such content as needed to provide and promote the Services (subject to our Privacy Policy).
You are solely responsible for Your Content and for any harm resulting from it. You represent that you have the rights needed to submit Your Content and that it does not infringe others’ rights. We may remove or refuse to display content that we believe violates these Terms or applicable law.
The Services may contain links to third-party websites, tools, or services. We are not responsible for those third parties’ practices or content. Use of third-party services may be subject to additional terms and privacy policies.
Where the Services include downloadable software, we may automatically update that software to provide fixes, patches, or new features. You agree that such updates may be applied automatically.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. THEMERELLA DEVELOPMENT TEAM AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THEMERELLA DEVELOPMENT TEAM, ITS AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR USD $50 IF NO PAYMENTS WERE MADE).
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Themerella development team and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, violation of these Terms, or infringement of any rights of a third party.
We may suspend or terminate your access at any time for violation of these Terms or for legal or technical reasons. If your account is terminated, your right to use the Services will end immediately. Termination does not limit our other rights or remedies.
These Terms are governed by the laws of the jurisdiction in which Themerella development team is established (unless otherwise required by local law). Any disputes arising from these Terms will be resolved in the competent courts of that jurisdiction, to the extent permitted by law.
These Terms constitute the entire agreement between you and Themerella development team regarding the Services. If any provision is found unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will remain in full force.
